1. General information - Conditions for accessing the Website

This Website is the property of ENGIE, a public limited company entered in the Nanterre Register of Companies under number 542 107 651, and having its registered office at Tour T1- 1 place Samuel de Champlain, 92400 Courbevoie, France.

This Website is available to you free of charge (except for Website connection costs).

Access to the Website is reserved for employees of ENGIE, provided that certain rules concerning the independence and confidentiality of commercially sensitive information ("CSI"), applicable to entities within the Infrastructure Branch, are respected. ENGIE reserves the right to suspend your access to the Website in the event that these Terms are not respected or if you no longer fulfill the conditions for accessing the Website. ENGIE also reserves the right to potentially restrict access to the Website, in part or whole, in order to respect constraints, particularly of a legal or regulatory nature, or the injunction of an independent administrative or regulatory authority, or confidentiality clause.

In using the Website, you agree to participate in such ways as fulfill your obligation to be loyal to your employer.

You agree to not share information in a manner that is contrary to current law and regulations or which disturbs public order or morality (notably, but not exclusively: justifying crimes against humanity, inciting racial hatred, etc.)

You must abstain from any act infringing on the privacy, honour, sensitivity, brand image or notoriety of any individual or legal entities, particularly of ENGIE, by avoiding any defamatory, provocative, malevolent, denigrating or in any way threatening mention, in any medium.

2. Password and access codes management

Your access codes and passwords are confidential, personal and nontransferable. You are responsible for their management, safekeeping and for the consequences of their use. You are responsible for taking the measures necessary for their protection and safekeeping. ENGIE may under no circumstances be held liable for any fraudulent use.

3. Limited liability and guarantees

As a user of the Website, you acknowledge that you have the necessary skills and means to access and use this Website.

ENGIE and its contributors make every effort to ensure that the information provided on this Website is accurate and up-to-date, reserving the right to modify the content at any time and without notice. However, they cannot guarantee that this information is complete, or that it has not been modified by a third party (hacking, virus, etc.). ENGIE and its contributors also accept no liability (direct or indirect) in the event of delay, error or omission with regard to the contents and use of these pages and in the event of the service being interrupted or unavailable. ENGIE may under no circumstances be held liable for any direct or indirect damage resulting from or subsequent to third-party distribution of a virus by means of our Website, which may infect your computer system following connection to this Website, use of this Website or browsing on this Website. Likewise, ENGIE may not be held liable for any material or consequential damage (including but not limited to technical failure, disclosure of confidential documents and data loss), or for any other indirect damage, arising from or associated with the use of the Website.

4. Intellectual property

The “ENGIE Innovation” website is governed by French law, especially but non exclusively regarding to intellectual property rights. Contributions to the Website are, subject to any applicable legal requirements, freely usable by ENGIE.

Any full or partial representation, modification, reproduction, distortion, of all or part of the Website or its contents, by any procedure whatsoever and in any medium whatsoever, constitutes a counterfeit, incurring the civil and criminal liability of the offender.

All intellectual property rights relating to the solutions and projects proposed by the Submitters on ENGIE’s open innovation platform called “ENGIE Innovation” remain the property of the respective Submitters.

Each Submitter certifies that he is the owner of the intellectual property rights and, by default, that he has all the necessary authorizations regarding the intellectual property rights related to the project at issue. He guarantees that he will defend, indemnify and hold ENGIE harmless from and against any claims, actions, costs, suits and proceedings whatsoever from a third party grounded on the solutions and projects presented, which they declare to be their own personal matter.

Each Submitter certifies that he is not subject to any obligation or limitation concerning his or her project and/or the creations that may result therefrom, which could limit his or her capacity as a Submitter to the “ENGIE Innovation” platform.

Submission of a solution and project by a Submitter on “ENGIE Innovation” shall not grant ENGIE the right to use such solution and project for any commercial or industrial use.

ENGIE agrees to limit the use of the information contained in the solution and project submitted by the Submitter for internal purpose exclusively: this information shall not be shared outside the ENGIE Group without the express permission of the Submitter. Each Submitter will be the sole judge of the suitability and means of protecting its confidential information by claiming such right.ENGIE may ask the Submitter to justify the information contained in the solution and project.

Any inexact or false declaration, or any fraud, will lead to the immediate termination of the relationship between ENGIE and the Submitter.

ENGIE will not be held responsible for any fraud committed by the Submitter. In the event that the Submitter infringes these terms, ENGIE may terminate all relations with the Submitter immediately with no right to compensation whatsoever for the Submitter.

5. Personal information

The ENGIE Innovation treatment is implemented by ENGIE SA, 1 Samuel de Champlain Square - Faubourg de l'Arche - 92400 Courbevoie.

Your data is collected on the basis of consent in order to be able to contact you for collaboration with the ENGIE Group following your response to a call for proposals or your proposal for an innovative solution.

Your data is kept for 5 years after the creation of your profile or 3 years after your last connection to your profile. They are reserved for the use of the ENGIE innovation department and the ENGIE operational entities innovation sector wishing to work with startups or innovative companies.

In accordance with the applicable regulations, you may request access, rectification or erasure of your personal data. You also have the right to object, limit and port your data.You can exercise all these rights by contacting: innov-admin@engie.com. All requests must be accompanied by proof of identity.

The collection and processing of your data is based on your consent, you are informed that you have the opportunity to withdraw at any time by sending an email to innov-admin@engie.com

6. Cookies
